Abstract

The activity of many companies extends beyond the borders of the State of which the company is a national ", owing to its extensive activity and indispensable experience in production and services, Because the majority of countries encourage foreign investment as one of the means of economic and scientific growth foreign investment usually depends on an activity that takes the form of companies or their subsidiaries, Foreign commercial activity beyond the limits of the State in which that activity is located takes several problems. Companies may be established in the other country where they operate. in accordance with Iraqi Law No. 21 of 1997, as amended, and the Foreign Investment Law promulgated under (Ordinance No. 39 of 2003), natural or moral persons have the right to establish companies in Iraq under the terms of the said laws; In this case, we are before an Iraqi company established under Iraqi law and its Iraqi nationality. s legal status and nature, Also indicate how foreign companies are registered and the applicable law, using the analytical approach and indicate the adequacy of these legislation and their familiarity with the regulation of foreign companies in Iraq.
