Abstract

The principle in carrying rulings on their subjects is the specificity of each ruling for its subject and does not transgress to others, but because it is not possible for each subject of life to have a ruling that is specific to it; It suffocated it first, and to create new topics secondly, so the jurists sought to abolish that specificity based in the mind and strip it of it, through several attempts, including refining the premise and extracting the angel and the reason upon which the legal ruling depends or the occasions linking the ruling and the subject, or taking the burden between them on idealism and others or By religious devotion imposed by the text, to transgress the provisions to other than their subjects, broad and narrow, in accordance with what helps to achieve reassurance of the authority of this transgression in the sacred law, and to show evidence of that; By stripping the ruling contained in the language of the guide from all its peculiarities, And extracting a major general rule that makes what is contained in it one of its applications, so it applies to him and others.
