The bank safes lease contract differed among legal scholars and researchers on the subject. Some of them considered that the safe and its contents are the client’s property, and at the same time they are in the custody and custody of the bank. Therefore, the bank safes lease contract has a personal nature through which the bank appears to be keen on Choosing his hired clients to have moral qualifications and famous for their integrity, good deeds and the integrity of their actions in various matters of life, whether commercial, civil or political; The banks thus avoided the occurrence of damages that result from those who are not at a moral level suitable for civil or commercial dealings, which called on the Iraqi legislator to intervene to avoid any harm, by issuing the Iraqi Trade Law No. (30) of 1984 AD amended, which was dealt with in some of its articles Renting bank safes, and this is what we will address in the folds of this research.
The contract for renting safes is a consensual contract, but the bank is characterized by independence when writing the terms of this contract, as the role of the customer is limited to signing it only, but it cannot be considered a contrac
of compliance. Because the customer here is not the weak party in the contract, as he has the freedom to choose the bank from which he wishes to rent the bank safe. The conclusion of this contract entails several obligations on both parties, the bank and the customer, but it differs from other consensual contracts with these strict obligations. Due to the importance and confidentiality of what the rented customer may store for the bank treasury, which prompted us to research and analyze the nature of this contract to distinguish it from other consensual contracts, and this is what we will find in the folds of this research.
