Abstract

Constitutional supremacy is followed by the necessity of constitutional oversight, and this oversight, although it is a means alongside many methods in modern countries, guarantees the enforcement of constitutional law and the commitment of various state authorities to its rules. Judicial oversight of the constitutionality of laws is based on a sound legal basis, and has become a necessary necessity to ensure the supremacy of constitutional rules. Constitutional supremacy does not prevent the ruling authorities from exercising their jurisdiction to issue legislative regulations in exceptional circumstances This study came to evaluate the principle of constitutional supremacy in modern democratic systems, and showed us that the concept of the principle of constitutional supremacy should be reconsidered in order to achieve the goal and proportionality between democracy and respect for established constitutional rules.
